1. General provisions

  1. The online shop http://slackhouseshop.pl is run by SLACKHOUSE Sp. z o.o. registered under the numbers: KRS 0000553629, NIP 7262656478, REGON 361282250, share capital PLN 50 000, running under the address: Czeremchy 11, 91-866 Łódź, Poland, with electronic contact: e-mail biuro@slackhouse.pl, mobile +48 502 958 102.
  2. Each User at the moment of undertaking activities aiming at using the Store, it is obliged to read and comply with these Terms and Conditions.
  3. The condition for placing an Order in the Store by the Customer is to read and accept the Terms and Conditions at the time of placing the Order.

2. Definitions

  1. WORKING DAY – one day from Monday to Friday, excluding public holidays.
  2. REGISTRATION FORM – a form available in the Store that allows you to create an Account.
  3. ORDER FORM – a form available in the Store that allows you to place an Order.
  4. CONSUMER – a User being a natural person and performing a legal action with the Seller that is not directly related to the business or professional activity.
  5. CUSTOMER – Customer who intends to conclude or conclude a Sales Agreement with the Seller.
  6. ACCOUNT – marked with an individual name (login) and password, a set of resources in the Service Provider’s IT system in which the Customer’s data is collected, including information about orders placed.
  7. NEWSLETTER – an Electronic Service that allows the Customer to subscribe and receive to the e-mail address provided by the Customer free information from the Service Provider, containing information about the Products, sales and promotions in the Store.
  8. PRODUCT – a movable item or service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
  9. TERMS AND CONDITIONS – these regulations of the Store.
  10. SHOP – online Store operating at the internet address http://slackhouseshop.pl
  11. SELLER, SERVICE PROVIDER – SLACKHOUSE Sp. z o.o., KRS: 0000553629, tax identification number: 7262656478, REGON: 361282250, share capital PLN 50,000, address of the place of business and delivery address: ul. Czeremchy 11, 91-866 Łódź, Poland.
  12. SALES AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller via the Store.
  13. ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Customer through the Store.
  14. USER – a natural person, a legal person or an organizational unit without legal personality, the law of which grants legal capacity, using or intending to use the Electronic Service.
  15. ORDER – Customer’s declaration of intent submitted via the Order Form and aiming directly at the conclusion of the Product Sales Agreement with the Seller.

3. Terms of providing Electronic Services

  1. The Service Provider enables the use of the following Electronic Services via the Store:
    1. placing Orders for Products located in the store database via the Order Form,
    2. creating and maintaining an Account on the Store website,
    3. subscription to a newsletter containing commercial information.
  2. The provision of Electronic Services is free.
  3. The contract for the provision of Electronic Services consisting in maintaining an Account and / or subscription to the Newsletter in the Store is concluded for an indefinite period.
  4. The contract for the provision of Electronic Services consisting in the possibility of placing an Order in the Store is concluded for a definite period of time and shall be terminated upon the submission of the Order or cease its submission by the Customer.
  5. The condition for using the Electronic Services provided by the Service Provider is to meet the minimum technical requirements, such as:
    1. a computer, laptop or other multimedia device with Internet access,
    2. access to electronic mail,
    3. Internet browser (Mozilla Firefox version 17.0 and above or Internet Explorer version 10.0 and higher, Opera version 12.0 and higher, Google Chrome version 23.0 and higher, Safari version 5.0 and higher),
    4. enabling cookies and Javascript in your browser.
  6. The User is obliged to use the Store in a manner consistent with the law and morality with respect for the personal rights and intellectual property rights of the Service Provider and third parties.
  7. The User is obliged to enter data consistent with the actual state.
  8. The User is prohibited from providing unlawful content.
  9. The User can terminate the contract with immediate effect and without indicating reasons by sending a request to delete the Account and / or delete the e-mail address from the list of subscribers to the Newsletter, via e-mail to the following address: sklep@slackhouse.pl
  10. The Service Provider deletes the registered Customer Account and / or e-mail address from the list of subscribers without undue delay.
  11. The Service Provider may terminate the contract for the provision of Electronic Services in the event that the User violates the provisions of these Regulations.

4. Conditions for concluding a Sales Agreement

  1. The information on the Store’s websites does not constitute an offer within the meaning of the law. By placing an Order, the Customer submits an offer to buy a specific Product on the terms specified in its description.
  2. The Product price shown on the Store website is given in EUR and includes all components, including VAT, customs and other taxes in Poland. The price does not include delivery costs.
  3. All other costs in the recipient country, such as import taxes, duty, fees etc. are borne by the Customer.
  4. If the delivery address provided by the Customer is located outside the European Union, all prices in the Store are reduced by the VAT amount (23%).
  5. The Product price shown on the Store’s website is binding at the time the Customer places an Order. This price will not change regardless of changes in prices in the Store, which may occur in relation to particular Products after placing an Order by the Customer.
  6. In order to place an Order, the Customer is not obliged to register an Account in the Store.
  7. Orders can be placed:
    1. via the Store website (http://slackhouseshop.pl) using the Order Form – 24/7 throughout the year,
    2. via e-mail to the following address: sklep@slackhouse.pl.
  8. The store executes Orders placed from Monday to Friday during the Store’s working hours, from 10:00 to 16:00. Orders placed on working days after 16:00, on Saturdays, Sundays and holidays, will be processed on the next Business Day.
  9. Conclusion of the Sale Agreement:
    1. To conclude a Sales Agreement it is necessary for the Customer to submit the Order via ways provided by the Seller in advance.
    2. After placing the Order, the Seller immediately confirms acceptance of the Order, which causes the Customer to be bound by the Order. Confirmation of the Order shall take place by sending an e-mail that includes confirmation of all essential elements of the Order.
  10. When the Customer receives an e-mail, a Sales Agreement is concluded between the Customer and the Seller.
  11. The Sales Agreement, at the Customer’s request, can be confirmed by proof of purchase (VAT invoice), which will be attached to the shipment.

5. Payments

  1. The Seller provides the following payment methods:
    1. payment by bank transfer directly to the Seller’s bank account,
    2. cash payment upon personal collection,
    3. cash on delivery (only for delivery address within Poland),
    4. payment via electronic payment services – possible current payment methods are specified on the Store website in the “Forms of payment” tab.
  2. In the case of payment by bank transfer, the payment should be made to the bank account number: PL67 1750 0012 0000 0000 3505 3727 (BNP Paribas Bank Polska S.A.) SLACKHOUSE Sp. z o.o., ul. Czeremchy 11, 91-866 Łódź, NIP: 7262656478. Please enter the order number, in the transfer details.
  3. In the case of payments via electronic payment services (Tpay.pl, PyaPal), the Customer pays before the execution of the Order. Electronic payment services allows for the payment using a credit card or a quick transfer. The Product will be sent only after payment.
  4. The Customer is obliged to pay the amount of the Order under the Sales Agreement within 5 calendar days from the date of its conclusion, unless the Sales Agreement states otherwise.

6. Delivery terms

  1. The delivery of the Product is determined during the Order placement process and depends on the choice of payment method, delivery method and the weight of the purchased Product.
  2. The Products purchased from the Store are sent via courier companies: DPD, DHL, TNT, FedEx, GLS.
  3. The Customer can personally pick up the Product at the following address: Czeremchy 11, 91-866 Łódź.
  4. The delivery time of the Product consists of the time of completing the Product and the time of delivery of the Product by the carrier:
    1. The time of completion of the Product is from 1 to 3 Business Days.
    2. For the Product marked as “Available on backorder”, the completing time is up to 10 Business Days.
    3. Delivery time of the Product is defined by the destination country/region and is specified on the Store website in the “Shipment” tab.

7. Complaints procedure

  1. We cannot be held responsible for any damaged, either on your health or belongings, incurred by doing slackline. We do not assume nor accept any responsibility caused due to the product improper use or due to using damaged products.
  2. All slackline gear and products are to be used at the maximum height of 1 meter above the ground, and are not to be used for highline under any circumstances.
  3. Customer complaints procedure:
    1. Notices of defects regarding the Product can be made via email to the following address: sklep@slackhouse.pl or in writing to the following address: Czeremchy 11, 91-866 Lodz, Poland.
    2. In the above e-mail Customer should provide information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of defects and contact details. The information provided will significantly accelerate the complaint handling by the Seller.
    1. When it is necessary to assess the physical defects of the Product, it should be delivered to the address: Czeremchy 11, 91-866 Lodz, Poland.
    2. The Seller will respond to the Customer’s request promptly, but no later than within 14 days. The response to the complaint is sent to the e-mail address provided by the Customer or in another manner provided by the Customer.
    3. In the case of Customer being a Consumer – failure to examine a complaint within 14 days is synonymous with its positive consideration. In connection with the complaint of the Customer being a Consumer, the Seller covers the costs of returning and delivery of the Product for free from defects.
  4. Complaints related to the Electronic Services provided by the Service Provider:
    1. Complaints related to the provision of Electronic Services via the Store, the Customer may submit via e-mail to the following address: sklep@slackhouse.pl.
    2. In the above e-mail Customer should provide information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of problem and contact details. The information provided will significantly accelerate the complaint handling by the Service Provider.
    3. Consideration of the complaint by the Service Provider takes place immediately, but no later than within 14 days.
    4. The response of the Service Provider regarding the complaint is sent to the Customer’s e-mail address provided in the complaint form or in another way provided by the Client.

8. The right to withdraw

  1. The Customer who is also a Consumer may withdraw from the contract without giving reasons, by submitting a relevant statement within 14 days from receiving the Product.
  2. In the event of withdrawal from the contract, the Sales Agreement is considered void. The Consumer returns the Product in its unaltered state, unless the change was necessary to determine the properties and features of the Product. The return should take place immediately, however not later than within 14 days.
  3. The consumer is liable for the decrease in the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the characteristics and functioning of the Product.
  4. The Seller will refund the value of the Product along with the cost of its delivery using the same method of payment as used by the Consumer unless the Consumer has expressly agreed to a different method of return, which does not involve any costs for him.
  5. If the Consumer has chosen the method of delivery of the Product other than the cheapest delivery method offered by the Store, the Seller is not obliged to refund the additional costs incurred by the Consumer.
  6. Consumer withdrawing from the Sales Agreement in accordance with point 1 of this chapter, shall bear the costs of returning the Product to the Seller.
  7. The fourteen-day period, in which the Consumer may withdraw from the contract, counts from the day on which the Consumer took possession of the Product.
  8. The right to withdraw from a distance contract is not payable to the Consumer in the case of a Sales Agreement:
    1. in which the object of the service is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to satisfy his individual needs,
    2. in which the subject of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery,
    3. in which the subject of the service is something that is quickly deteriorating or has a short shelf-life.
  9. The right to withdraw from the Sales Agreement is vested in both the Seller and the Customer (the Consumer) in the event of the other party failing to fulfill its obligations within a strictly specified period.

9. Intellectual property

  1. All content on the website http://slackhouseshop.pl is copyright protected and owned by the Service Provider. The User bears full responsibility for the damage caused to the Service Provider, which results from the use of any content on the http://slackhouseshop.pl website, without the consent of the Service Provider.
  2. Any use by anyone, without the express written consent of the Service Provider, of any of the elements making up the content of the http://slackhouseshop.pl website is a violation of the copyright of the Service Provider and results in civil and criminal liability.

10. The rules of posting opinions about Products

  1. The Service Provider allows posting opinions about Products available in the Shop’s offer.
  2. Submitting the opinion is voluntary and means the consent of the User for free access to the opinion by other Customers of the Store and the Service Provider.
  3. Opinions are published at the Product page which they referred to, within 7 days from the date of their publication, for an indefinite period.
  4. Opinions posted may not contain unlawful content, in particular:
    1. violating any rights of third parties (including legal persons),
    2. calling for hatred or violence,
    3. be offensive, against the law, good manners and social norms,
    4. conflicting with the interests of the Service Provider (unfair competition).
  5. The Service Provider reserves the right not to include all or part of the opinion when its content may violate the provisions of these Terms and Conditions or applicable law.

11. Final Provisions

  1. Contracts concluded through the Store are concluded in accordance with Polish law.
  2. In the event of any incompatibility of any part of the Regulations with applicable law, the relevant provisions of Polish law apply instead of the challenged provision of the Regulations.
  3. Any disputes arising from the Sale Agreements between the Store and Consumers will be resolved first through negotiation, with the intention of amicably settling the dispute. However, if it would not be possible or would be unsatisfactory for either party, disputes will be resolved by the competent common court, in accordance with point. 4 of this chapter.
  4. Any disputes arising between the Service Provider and the Customer who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of November 17, 1964 (Journal of Laws No. 43, item 296, as amended).
  5. Any disputes arising between the Service Provider and the Customer who is not a Consumer shall be submitted to the court competent for the seat of the Service Provider.
  6. The Customer who is a Consumer has the right to use extrajudicial dispute resolution. For the purpose of an amicable settlement of a dispute, a consumer may, for example, file a complaint via the online platform ODR (Online Dispute Resolution), available at: http://ec.europa.eu/consumers/odr/.
  7. The Customer who is a Consumer also has the right to use extrajudicial dispute resolution.
  8. In matters not covered by these Regulations, the following provisions shall apply: Act on Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended),
  9. Consumer Rights Act of 30 May 2014 (U. 2014, item 827),
  10. Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) and other relevant provisions of Polish law.
